Deadly Deltona shooting stemmed from self-defense, road rage incident: deputies

There was a significant presence of law enforcement officers along Deltona's Fisher St. shortly before 11 p.m. on Thursday.  

The Volusia County Sheriff's Office said deputies were investigating a deadly shooting and that the shooter was at the scene and being interviewed by detectives. In an update, deputies said the shooter was shooting in self-defense during a road rage incident. 

The alleged shooter stayed on the scene to report what happened and to share his side, according to the Volusia Sheriff's Office.

He said he passed a white Dodge Charger that slowed down in front of him on DeBary Avenue, and then the Charger began to follow him closely with his high beams on. After the Charger backed off, it reappeared, sped up to drive alongside him and then cut him off. 

"He told detectives the driver of the Charger got out of the vehicle and approached, yelling, with a firearm in his hand," deputies said. "When he saw the driver raising the firearm, he feared for his life and fired several rounds from his own weapon." 

A witness' account to deputies corroborated the shooter's story.

"The witness indicated he heard the other driver say something to the effect of ‘I don’t want any problems’ multiple times before multiple gunshots were fired," deputies wrote. 

After the shooting, the shooter ran up to the driver who was lying on the ground to check on him and render aid, the witness told Volusia Sheriff's Office deputies.

The victim was identified as 37-year-old Kenyon Ashley of Deltona.

Both of their guns, shell casings, projectiles and vehicles were recovered from the scene. 

The Volusia Sheriff's Office said their findings do not support any criminal charges at this time. 

The case remains active and the State Attorney's Office will make a final determination.
